Impact on Law Enforcement
On October 3, 2015, Governor Brown, signed into law Senate Bill 11<http://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=201520160SB11> and Senate Bill 29<http://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=201520160SB29>. In brief, the resulting laws mandate mental health training for Field Training Officers (FTO), an increase in hours in Learning Domain 37 of the Regular Basic Course, and POST to create, maintain, and make available a three hour mental health course. This information is intended to facilitate an understanding of the new laws and how they will be implemented. Please refer to the California Penal Code (PC) for a full description of each law.
California Penal Code 13515.29
(a) The commission shall establish and keep updated a field training officer course relating to competencies of the field training program and police training program that addresses how to interact with persons with mental illness or intellectual disability.
With the aforementioned legislative mandate Commission on POST posted the following on its web site:
By May 2016, POST will conduct an evaluation of the required competencies of the FTO program and Police Training Program. The goal of the evaluation is to identify areas where additional training is necessary to help law enforcement officers effectively address incidents involving persons with a mental illness or intellectual disability. This law requires an update to the current Field Training Manuals. POST will not require agencies to re-submit their entire field training manual for this update to mental health field training. POST will provide agencies with the necessary mental health competency changes, and an attestation form to verify that the changes have been incorporated into their field training program.
POST Basic Training Bureau (BTB) who manages the FTO/FTP recently contacted my Bureau - Training Delivery and Compliance (TDC) and advised that a number of POST participating agencies have not completed the necessary competency and attestation documents (attached). I checked the roster as provided by BTB for agencies in Region 10; there are are good number of agencies who have not sent in their attestations asserting meeting the legislative mandate. As this training requirement is a legislative mandate, please ask your FTP/FTO Managers and Supervisors to complete the necessary updates to your agency's Field Training Manual if they have not done so. Further, please direct that the attestation is completed and sent to Commission on POST as soon as possible.
